Welcome to Summet. The terms "we", "us" and "our" refer to Summet. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Summet is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services. They form a binding agreement between you and Summet, so please read them carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree to them, you should not use or access our Services.
1. Using our site
By agreeing to these Terms, you confirm that you are at least the age of majority in your state, province or country of residence, and that you consent to any minor dependents using the Services on devices you own, purchase or manage.
To use the Services, including browsing our store or purchasing anything we offer, you may be asked to provide information such as your email address and your billing, payment and shipping details. You confirm that everything you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.
2. Our products
We make every effort to represent our products accurately. Please note that colors and product appearance may differ from how they look on your screen, depending on the device you use and its settings.
We do not warrant that the appearance or quality of any product you purchase will meet your expectations or match exactly how it is shown in our store.
All product descriptions are subject to change at any time without notice, at our sole discretion. We may discontinue any product at any time, and we may limit the quantities we offer to any person, geographic region or jurisdiction on a case-by-case basis.
3. Orders and acceptance
When you place an order you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before that happens.
Please review your order carefully before submitting it, as we may not be able to accommodate cancellation requests once an order has been accepted. If we decline, change or cancel an order, we will try to notify you using the email address, billing address or phone number you provided.
Your purchases may be returned or exchanged only in accordance with our Return & Refund Policy, which forms part of these Terms.
You confirm that your purchases are for your own personal or household use, and not for commercial resale or export.
4. Prices and payment
Prices, discounts and promotions may change without notice. The price charged is the price in effect when you place your order, and it will be set out in your order confirmation email. Unless we expressly state otherwise, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices in our online store may differ from prices offered elsewhere, including in stores operated by third parties. From time to time we may run promotions governed by their own terms. Where those terms conflict with these Terms, the promotion terms apply.
You agree to provide current, complete and accurate purchase, payment and account information, and to keep it updated so that we can complete your transactions and contact you when needed.
You confirm that the payment information you provide is true, correct and complete, that you are authorized to use the payment method, that charges will be honored by your card issuer, and that you will pay the amounts due at the posted prices, including shipping, handling and any applicable taxes.
5. Shipping, delivery and risk
Delivery timeframes are estimates only and are not guaranteed. We are not liable for shipping or delivery delays, including delays caused by carriers, customs processing, or events outside our control.
You are responsible for entering a correct and complete shipping address at checkout. Once we hand your order to the carrier, title and risk of loss pass to you.

6. Returns and refunds
Returns, exchanges and refunds are handled in accordance with our Return & Refund Policy and our 30-Day Take-It-Off Test, each of which forms part of these Terms.
Please contact us before sending anything back. Returns must be approved by us first, and refunds, where approved, are issued to the original payment method only.
7. Disputes and chargebacks
If you have any concern about an order, a charge or a delivery, please contact us first at hello@getsummet.com so that we can resolve it directly. We reply to every email, usually within one business day, and we resolve most issues in a single exchange.
By agreeing to these Terms, you agree to raise any billing concern with us before initiating a chargeback or payment dispute. Initiating a chargeback for an order that was delivered as described, or that falls outside the terms of our published policies, may be treated as a breach of these Terms. We reserve the right to submit our records in response, including order, delivery, tracking and communication history.
8. Text messages and marketing
If you provide your mobile number, you agree to receive recurring automated marketing and order-related text messages from Summet. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.
Reply STOP to any message to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages. We do not share mobile information with third parties or affiliates for their own marketing or promotional purposes. Questions: hello@getsummet.com.
9. Intellectual property
The Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by Summet, its affiliates or its licensors, and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent. Except as expressly provided here, nothing in these Terms grants you a license or any other rights under any patent, trademark, copyright or other intellectual property of Summet, Shopify or any third party. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted are reserved.
Summet's names, logos, product and service names, designs and slogans are trademarks of Summet or its affiliates or licensors, and you must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and marks on the Services belong to their respective owners.
10. Feedback and reviews
If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, proposals, plans or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use. We may use these rights to operate, provide, evaluate, enhance, improve and promote the Services.
You confirm that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentive received in connection with it; and (iii) it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.
Your Feedback must not violate any third-party right, including copyright, trademark, privacy or personality rights, and must not contain unlawful, abusive or obscene material, or any virus or malware. You may not use a false email address, impersonate anyone, or otherwise mislead us or others about the origin of your Feedback. You are solely responsible for your Feedback and its accuracy, and we assume no liability for Feedback posted by you or any third party.
11. Third-party tools and links
You may be given access to third-party tools through the Services that we neither monitor nor control. We provide access to these tools "as is" and "as available", without warranties, representations, conditions or endorsement of any kind, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk, and you should make sure you are familiar with and approve of the provider's own terms.
The Services may also contain materials and links to websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating their content or accuracy, and if you choose to leave the Services to access them, you do so at your own risk.
We are not liable for any harm or damage related to your use of third-party websites, or your purchase or use of any products, services, resources or content on them. Please review the third party's policies carefully before transacting with them, and direct any complaints, claims or questions about their products and services to them.
We may offer new features and tools through the Services in future. These will also form part of the Services and be subject to these Terms.
12. Our relationship with Shopify
Summet is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Summet. You acknowledge that Shopify is not responsible for any aspect of any sale between you and Summet, including any injury, damage or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Summet.
13. Privacy
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read both.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and with third parties that may be located in countries other than where you reside, in order to provide services to you. 14. Errors, inaccuracies and omissions
Occasionally there may be information in the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any such errors, and to change or update information or cancel orders, at any time without prior notice, including after you have submitted your order.

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial, state or local law, rule, regulation or ordinance; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate our employees or any other person; (e) to transmit false or misleading information; (f) to send, receive, upload, download or re-use any material that does not comply with these Terms; (g) to transmit or procure the sending of any advertising or promotional material, including junk mail, chain letters or spam; (h) to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that may harm Summet, Shopify or other users, or expose them to liability.
You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl or scrape; or (e) interfere with or circumvent the security features of the Services or any related website. We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
16. Termination
We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion and at any time without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections continue to apply after any termination: Intellectual Property, Feedback and Reviews, Disputes and Chargebacks, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, General Terms, Governing Law, Privacy, and any other provision that by its nature should survive.
17. Disclaimer of warranties
The information presented through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness or usefulness. Any reliance you place on it is strictly at your own risk, and we disclaim all liability arising from any reliance placed on it by you or any other visitor.
EXCEPT AS EXPRESSLY STATED BY SUMMET, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. 18. Limitation of liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL SUMMET, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY IN CONNECTION WITH ANY ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER.
19. Indemnification
You agree to indemnify, defend and hold harmless Summet, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, though a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such a claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defense of indemnified claims, including by providing relevant documents.
20. General terms
Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable part will be severed. This will not affect the validity or enforceability of the remaining provisions.
Waiver and entire agreement. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with any policies we post on this site, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements, communications and proposals, whether oral or written, including any earlier versions of these Terms. Any ambiguity will not be construed against the drafting party.
Assignment. You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.
Headings. Headings are included for convenience only and do not limit or otherwise affect these Terms.
21. Governing law
These Terms, and any separate agreement under which we provide you the Services, are governed by and construed in accordance with the laws of Wyoming, United-States, without regard to its conflict of law rules. You and Summet consent to the exclusive venue and personal jurisdiction of the state and federal courts located in Wyoming, United-States for any dispute arising out of or relating to these Terms or the Services.
Nothing in this section removes any mandatory consumer protection rights you have under the law of the country in which you live.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically.
